JAKARTA, NETRALNEWS.COM - The Indonesian Consumer Community (Komunitas Konsumen Indonesia/KKI) has filed a lawsuit against online shopping platform Tokopedia and the Indonesia Minister of Communication and Information regarding the leak of millions of user data. The KKI suit was filed in the Central Jakarta District Court.

Akhmad Zaenuddin, defence council at KKI, said his party filed a lawsuit because Tokopedia, as the organizer of the electronic system, made a mistake that resulted in the leakage of personal data of the platform's users.

According to KKI, in the statutory regulatory system in Indonesia, personal data is defined as certain individual data that is stored, maintained, and preserved, and is protected by confidentiality.

The regulation is contained in Article 1 number 22 of Law Number 24 of 2013 on Amendment to Law Number 23 of 2006 concerning Population Administration, in conjunction with Article 1 number 20 of PP Number 71 of 2019 on Operation of Electronic Systems and Transactions, in conjunction with Article 1 number 1 of PM of Communication and Information Number 20 of 2016 on Protection of Personal Data in Electronic Systems.

The state requires each party that obtains personal data to maintain confidentiality and protect the personal data and privacy of citizens who conduct electronic transactions.

KKI Chairman David Tobing regretted that Tokopedia did not inform the details of the data that was stolen and had been controlled by a third party, as reported by Antara on Thursday (05/07/2020).

Whereas for the Minister of Information and Communication, KKI assessed that there is an oversight of the implementation of the electronic system so that personal data leakage happened.

The Ministry of Communication and Information has the authority to carry out monitoring, control, inspection, tracking, and security activities in accordance with the provisions stipulated in Article 35 paragraph (1) Government Regulation Number 71 Year 2019.

Minister of Communication and Information Johnny Plate said his office formed a team with the National Cyber and Coding Agency (BSSN) and Tokopedia to evaluate the user data leak on the shopping platform.

Meanwhile, the Indonesian government ensures that the digital economy, especially in the field of e-Commerce, can run smoothly by following up on  the data leak case and improving security systems to protect user data
